Notary choice
The deed of sale will be drawn up in accordance with the model of the Royal Notarial Professional Organization Amsterdam, at a notary office to be appointed by the buyer in the Amsterdam region. The choice of notary must be announced by the buyer within 3 working days after agreement of will (of after agreement has been reached). The signing of the deed of sale must be completed within 7 working days after agreement of will (unless agreed otherwise).
Placing bids
For the purpose of the progress of the sale and delineation of responsibilities, we hereby like to state the sales conditions in case a prospective buyer does not wish to use expert purchase guidance in the form of a sworn or certified broker.
If the prospective purchaser chooses to do so when entering into negotiations, he must demonstrate to the selling broker that the underlying proposal is sufficiently financially guaranteed. This can be demonstrated by, for example, contracting with or issuing advice given by an expert and recognized financial institution or advisor. A bid must consist of a price, delivery date, movable property and any resolutive conditions.
- Bids will only be processed if they have been sent in writing (by post, fax and/or email) to the selling broker, accompanied by a copy of a valid ID.
- The seller and his broker will inform the prospective buyer of everything that should be brought to the knowledge of the buyer, on the understanding that information about facts that are known to the buyer or could have been known from his own investigation, insofar as such an investigation into the prevailing traffic opinions may be required from the buyer, need not be provided by the seller and/or his broker. Prospective purchaser accepts his obligation to investigate as such. The prospective buyer should consult the sources of information commonly used for sale.
- Bids remain in effect until the moment when the seller (and/or his broker) replies with an acceptance, the making of another proposal or by rejecting the proposal made by the prospective buyer.
Three days to consider
Since September 1, 2003, the “Law on the sale of immovable property” has been in force. The consequences of this law for the housing market and brokerage can be summarized in two main points: three days for cooling off the buyer and recording the purchase in writing.
Undo the cooling-off period. This reflection period is of imperative law: the buyer and seller cannot agree that it does not apply. During the reflection period, the buyer can, however, voluntarily waive the remaining reflection period. The reflection period starts on the day following the day on which the buyer has received (a copy of) the deed of sale signed by both parties. The exact time when the buyer receives the deed is not important.
Documenting
In contrast to the situation before 1 September 2003, the purchase of a home (by a consumer) is only concluded when the purchase deed has been signed by the buyer and seller. Until then, there is no legally valid purchase.
